Case Briefing

To fully understand the law with respect to business, you need to be able to read and understand court decisions. To make this task easier, you can use a method of case analysis that is called briefing. There is a fairly standard procedure that you can follow when you “brief” any court case. You must first read the case opinion carefully. When you feel you understand the case, you can prepare a brief of it. While you are free to consult outside sources to better help you understand the cases, you must use your own words when writing your brief.

Although the format of the brief may vary, typically it will present the essentials of the case under headings such as those listed below.

  1. Citation. Give the full citation for the case, including the name of the case, the date it was decided, and the court that decided it.
  2. Facts. Briefly indicate (a) the reasons for the lawsuit; (b) the identity and arguments of the plaintiff(s) and defendant(s), respectively; and (c) the lower court’s decision—if appropriate.
  3. Issue. Concisely phrase, in the form of a question, the essential issue before the court. (If more than one issue is involved, you may have two—or even more—questions here.)
  4. Decision. Indicate here—with a “yes” or “no,” if possible—the court’s answer to the question (or questions) in the Issue section above.
  5. Reason. Summarize as briefly as possible, in your own words, the reasons given by the court for its decision (or decisions) and the case or statutory law relied on by the court in arriving at its decision.

HOMEWORK

Teams are an integral part of the health care environment. Patient care requires that a group of health care providers work together to provide the highest quality care possible. The group usually consists of people with varying levels of education, authority, and experience. Smriti Chand, in an online article at Management states, “All teams are groups but not all groups are teams. Teams often are difficult to form because it takes time for members to learn how to work together. People in every workplace talk about building the team, working as a team, and my team, but few understand how to create the experience of team work or how to develop an effective team. Belonging to a team, in the broadest sense, is a result of feeling part of something larger than oneself. It has a lot to do with your understanding of the mission or objectives of your organization.”

Chand, S. (2014). Group Dynamics: it’s characteristics, stages, types and other details. Management, YourArticleLibrary.com.

Begin by reading Case Study #6 – “Leading a Team” (Joint Patient Liaison Office: Building a Streamlined Unit) [PDF File size, 4.36 MB] which includes questions at the end. In a 4-5 page APA formatted Word Document address the questions posed at the end of the case study.

A case study is meant to show your ability to apply course concepts to the given scenario. You are expected to use theories, vocabulary, and examples to answer the questions given in the case study. Your paper should be written in clear and concise language that shows your ability to comprehend course material and relate it to problems.

A case study is an APA formatted short report or essay on a particular topic. The nature and format of a case study can vary widely, depending on the topic. In this course, I want yours to be detailed, focused on organizational behavior.

This should list the title of the article, which should include the study design, for example: “Leadership and Change” as well as your name, course name/number and date.
Introduction
This should not exceed 350 words and should contain a brief overview of the case study. The introduction should motivate and describe the issue being studied and summarize the main findings.
Case description
This should describe the case, including the role of the people and institutions involved and how the information was analyzed.
Discussion and Evaluation

Herrnson’s Concept of Political Parties Paper

Herrnson’s Concept of Political Parties Paper

We propose a theory of political parties in which interest groups and activists are the key actors, and coalitions of groups develop common agendas and screen candidates for party nominations based on loyalty to their agendas. This theoretical stance contrasts with currently dominant theories, which view parties as controlled by election-minded politicians. The difference is normatively important because parties dominated by interest groups and activists are less responsive to voter preferences, even to the point of taking advantage of lapses in voter attention to politics. Our view is consistent with evidence from the formation of national parties in the 1790s, party position change on civil rights and abortion, patterns of polarization in Congress, policy design and nominations for state legislatures, Congress, and the presidency. Herrnson’s Concept of Political Parties Paper.
