QUESTION

The law of defamation in Ireland is governed by European law, the Constitution, common law, and the Defamation Act 2009. The Defamation Act 2009 which repeals the Defamation Act 1961, and which was in force until the first day of 2010, now governs all claims of defamation arising since the commencement of the new legislation.

Defamation has traditionally been divided into two forms: libel and slander. Historically, libel was the written form of defamation, while slander was the spoken form. The advent of modern technology has made those definitions obsolete. The 2009 Act abolished the separate torts of libel and slander and replaced them with the ‘tort of defamation’. A joint venture between Groupe Danone, a French MNE, and Wahaha Group, the largest beverage maker in China, illustrates the trials and tribulations of forming alliances. The joint venture (JV), known as the Wahaha Joint Venture Company, began in 1996 with great fanfare. By 2005, however, trouble began to brew as Danone executives suspected Wahaha CEO Qinghou Zong of operating secret companies that mimicked the JV. After protracted legal battles, the two firms decided to terminate their relationship in September 2009, with Danone selling its 51 percent stake to Wahaha. So, what went wrong? Zong and Wahaha were guilty of opportunism in setting up mirror companies. Danone, however, is not an innocent victim, since they did not have a single executive at Wahaha’s headquarters and they did not oversee day-to-day operations in China. Moreover, political tensions between China and France, stemming largely from France’s criticism of China’s human rights policies, complicated French firms’ efforts to do business in China. (Source: David Barboza “Danone Exits Chinese Venture After Years of Legal Dispute,” New York Times, September 29, 2009, B8, New York Edition, http://www.nytimes.com/2009/10/01/business/global/01danone.html; David Barbazoa and James Kanter “A Chinese Company Fights Its French Partner,” New York Times, June 13, 2007, http://www.nytimes.com/2007/06/13/business/worldbusiness/13danone.html?pagewanted=all)

With these details, discuss the following questions: What preparations leading up to the alliance could have made it more effective? Was dissolution the only viable option? Which firm is responsible for the failure of the JV, and why?

You must post to two classmates for full credit.

Across health care settings, many different terms are used to describe the same or similar conditions. For example, a bed sore may alternatively be called a pressure sore, a pressure ulcer, or a decubitus ulcer. While it may be fairly manageable for a nurse to make the connection among these terms, the same cannot be said for a computer system. Nurses have the ability to reason and reflect upon their clinical knowledge. Computer systems are linear, relying on user input to output information. When diverse terms are used, systems are unable to make the connections between the data. For this reason, the health care industry is vigorously moving towards the standardization of terminologies.

Discussion: James Cimino’s Desiderata

Desiderata is a Latin word that translates to “something that is wanted or needed.” It is obvious that James Cimino had this translation in mind when he created his “Desiderata for Controlled Medical Vocabularies.” In his work, Cimino outlines 12 desiderata he believes the health care community should consider when constructing medical vocabularies. He also highlights the need to control the vocabulary used within terminology sets, as well as the requirements for doing so.

For electronic health records (EHR) and clinical decision support systems (CDS) to truly be successful, Cimino, along with many other health care professionals, expresses the vital need to standardize and control the terminology being used in health care settings.

For this Discussion, you will use one of Cimino’s desiderata (or themes) to critically appraise a nursing terminology set:

Cimino’s 12 themes for the 21st century:

· Vocabulary content

· Concept orientation

· Concept permanence

· Nonsemantic concept identifiers

· Polyhierarchy

· Formal definitions

· Reject NEC “Not Elsewhere Classified”

· Multiple granularities

· Multiple consistent views

· Representing context

· Graceful evolution

· Recognize redundancy

To prepare:

· Review the article “Desiderata for Controlled Medical Vocabularies in the Twenty-First Century” in this week’s Learning Resources. Consider how each theme aims to control the vocabulary used by nursing terminologies.

· Reflect on prominent standardized nursing terminologies sets, such as NIC, SNOMED, SABA, NANDA, and NOC. How might these terminologies compare to the requirements outlined in Cimino’s 12 themes?

· Select one nursing terminology set and one of Cimino’s themes to further examine. Does the terminology align with the requirements of this theme? Why or why not?

By Day 3

Post a brief description of the nursing terminology set and theme you selected. Explain whether this terminology aligns with the requirements and why. Provide terminology and vocabulary examples to support your answer.

· For this discussion I choose NANDA and Formal definitions. (If it difficult, you can choose NANDA and another one of the 12 Cimino’s Theme’s.

· APA Style, 500-600 words minimum, Master Degree Quality Discussion/assignment work.

Risk is inherent to every project. Some risks are more likely to occur than others, and some will have a greater impact to the project if realized. Although you cannot account for every risk, a thorough risk analysis and assessment can help minimize the liabilities of the project and ensure that your projects are successful.

Refer to Case 7.1, 7.2, 7.3, and 7.4 of your text. Each of these cases presents you with a project scope statement for a fictional project. You are to pick 1 of these cases on which to perform a risk analysis. After picking a case of your choice, you should address the following:

  • Summarize the project.
  • Discuss how the risk management process will be applied.
  • Identify potential risks associated with this project (you must come up with at least 5 different risks).
  • Use a risk assessment form to analyze identified risks.
  • Develop a risk response matrix to outline how you would deal with each of the risks.

Please use the following templates when writing your paper

  • Risk Assessment Form
  • Risk Response Matrix

In conducting the risk assessment and developing the risk response matrix, you can either develop the risk assessment form and the risk response matrix yourself, or you can use the templates provided in your text. Your submission should be 5 pages in length. Graphics are encouraged, and you are free to be creative with this assignment. Be sure to cite your sources using APA; include your references and in-text citations.
